General Terms and Conditions

1. Definitions

In these General Terms and Conditions the following terms shall have the following meanings:

1. ISIS Foundation: International Study-centre for Independent Search for truth Foundation located at De Ruijterstraat 72 in The Hague, registered under number 41151394 in the trade register of the Chamber of Commerce in The Hague.
2. The interested party: The natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the ISIS Foundation
3. Offer: Products and/or services offered by the ISIS Foundation, including (e-)books, (e-)articles and (e-)magazines.
4. Agreement: The agreement between Stichting ISIS and the interested party for the supply of materials and services in whatever form and in whatever manner.
5. Right of withdrawal: The possibility for the interested party to cancel the agreement.
6. Durable medium: Any instrument which enables information to be stored in a way accessible for future consultation and which allows the unchanged reproduction of the stored information.

The General Terms and Conditions of the ISIS Foundation are clearly legible for interested parties and are included in the webshop of the ISIS Foundation. Situations that are not included in these conditions must be assessed 'in the spirit of' these General Terms and Conditions.

2. The offer

1. The offer contains a complete and accurate description of the products and/or services offered. If Stichting ISIS uses images, these are a true representation of the offer. Mistakes or errors in the offer do not bind Stichting ISIS.
2. All images, specifications and data in the offer are indicative and cannot give rise to compensation or termination of the agreement.
3. Each offer contains such information that it is clear to the interested party what rights and obligations are attached to the acceptance of the offer. This concerns in particular:
   • the price;
   • the costs of shipping;
   • the manner in which the agreement will be concluded and the actions required for this;
   • the method of payment;
   • the method of delivery;
   • that the agreement after its conclusion under My profile (https://webshop.blavatskyhouse.org/my-account/) is archived, can be consulted and, if necessary, restored.
4. All prices are subject to printing and typographical errors. No liability is accepted for these errors.

3. The Agreement

1. The agreement is concluded at the moment the interested party accepts the offer and meets the conditions set (such as payment) and the (written) confirmation thereof by Stichting ISIS
2. If the interested party has accepted the offer electronically, Stichting ISIS will immediately confirm receipt of acceptance of the offer electronically.
3. If the agreement is concluded electronically, Stichting ISIS will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure web environment.
4. If the interested party can pay electronically, appropriate security measures will be taken.
5. The ISIS Foundation states in the webshop in the Shipping and Returns Policy (https://webshop.blavatskyhouse.org/verzend-en-retourneren/) the cooling-off period that interested parties have once they have received the ordered product and how complaints about the offer and/or services provided can be made known.
6. Each agreement is entered into under the suspensive conditions of sufficient availability of the offer.

4. Subscriptions

1. The (e-)annual subscriptions to the Lucifer magazine can start at any time and can be cancelled in writing, by e-mail and/or by telephone no later than one month before the start of the next calendar year (end of November).
2. The ISIS Foundation reserves the right to index subscription prices and implement price increases.

5. Delivery

1. Stichting ISIS will take the utmost care when receiving and executing orders for products and/or services. For example, it ensures that the products are properly packaged and prepared for shipment.
2. The interested party has the possibility to dissolve the agreement without giving reasons for 14 days. This cooling-off period starts on the day after receipt of the ordered.
3. During the cooling-off period, the interested party will handle the product and packaging with care. He will only unpack the ordered to the extent necessary to assess whether he wishes to keep the ordered. If he exercises his right of withdrawal, he will return the ordered product with all accessories supplied, as much as possible in its original condition, within 14 days. The interested party will make this known by sending an e-mail to Stichting ISIS. The interested party can demonstrate that the delivered product was returned on time by sending a copy of the proof of shipment in an e-mail.
4. If the interested party exercises his right of withdrawal, the costs of return shipping will be borne by Stichting ISIS. The ISIS Foundation will refund the postage costs after receipt of the returned goods. Refund will be made to the same bank account as the interested party used for the payment.
    
5. In the event of damage to the product due to careless handling by the interested party, the interested party is liable for any reduction in value of the product.
6. If the interested party has not indicated that he wishes to exercise his right of withdrawal after the period referred to in Article 5, paragraph 2, or has not returned the product to Stichting ISIS, the purchase is a fact.
7. Any defects or incorrectly delivered products must be reported to Stichting ISIS within 7 days of receipt by e-mail, including the telephone number of the interested party so that further arrangements can be made by telephone. These arrangements will be confirmed in writing by Stichting ISIS by e-mail. Return of the products must preferably be in the original packaging and in new condition.
8. In the absence of proper and timely notification, any claim against Stichting ISIS regarding defects in the product shall lapse.
9. If the ordered product is in stock, the ordered product will be shipped within 7 days if possible. If the ordered product is not in stock, shipping will be carried out as soon as possible but no later than within 30 days. If the order cannot be shipped in whole or in part within a week or 30 days, the interested party will be informed of this by e-mail. Shipping will then take place as soon as possible. If shipping is not possible within 30 days, the interested party has the right to terminate the agreement without costs, in writing, by e-mail. After termination, Stichting ISIS will return the amount for the undelivered product and the shipping costs within 14 days. The interested party is not entitled to compensation.
10. The risk of damage and/or loss of products rests with Stichting ISIS until the moment of delivery to the interested party or someone taking his/her place.

6. Payment

1. Interested party pays for the product in the manner agreed and stated in the webshop.
2. The interested party has the duty to report any inaccuracies in the payment details provided or stated to Stichting ISIS without delay.

7. Intellectual property rights

1. It is not permitted to reproduce or make public, in whole or in part, any products supplied without prior written permission from Stichting ISIS. It is not permitted to copy, modify or take any action on products in a manner that conflicts with or infringes on the intellectual property rights of Stichting ISIS or any party affiliated with it.
2. Nothing in these Terms and Conditions shall be construed as a transfer of any intellectual property rights or copyrights.

8. Confidentiality and privacy rules

1. The ISIS Foundation undertakes to take measures to ensure the confidentiality of confidential data of interested parties.
2. Through the webshop, interested parties give permission to store the data in the administration of Stichting ISIS that is necessary for the processing of the agreement in accordance with the privacy policy as stated on the webshop: https://webshop.blavatskyhouse.org/privacybeleid/.
3. When ordering products, interested parties may give permission to be included in the administration of interested parties of Stichting ISIS. for the purpose of future purchase of products and/or services or to inform interested parties about new or existing products and/or services.
4. At the request of an interested party, the ISIS Foundation will make known within 4 weeks at the latest which data of the interested party have been included in the administration.
5. Data of interested parties will be adjusted or removed from the administration at their request.

9. Complaints procedure

1. Complaints about the performance of the agreement must be submitted fully and clearly described within 2 months to Stichting ISIS, De Ruijterstraat 72 in The Hague or via the contact form on the website. https://blavatskyhouse.org/nl/contact/.
2. Complaints received will be answered within 14 days of receipt of the complaint. If a complaint requires a longer processing time, a response will be sent within 14 days with a confirmation of receipt and an indication of when a response to the complaint can be expected.
3. If a complaint is found to be (partially) justified, Stichting ISIS will (partially) replace/deliver the delivered products/services free of charge.

10. Disputes

1. This agreement is exclusively governed by Dutch law. Even if the interested party resides abroad.

11. Additional or deviating provisions

1. Additional or deviating provisions from these General Terms and Conditions may not be to the detriment of interested parties and must be recorded in writing or stored in a manner accessible to the interested party on a durable data carrier.
